A Contribution Policy Built for the Community

What do we need?

Anticipated legal fees are expected to be approximately $125,000-$150,000 based on the nature of the case and the party we are dealing with. All amounts are welcome and helpful, but for those living in Anthem Country Club and directly subject to this “agreement”, a contribution of $310 also brings along the symbolic value of choosing to contribute to fighting this problem rather than lining the pockets of Anthem Golf & Country Club, ClubCorp/Invited, and Apollo Group.

Records Transparency

Unlike Anthem Golf & Country Club, all financial records will be made publicly available and provided as close to real-time as possible, subject to technology and privacy limitations. Further, an isolated bank account will be utilized to keep funds separate, and if possible, overseen by an outside party with financial background, such as a CPA, CFO or similar. Reimbursement Policy

This is an endeavor to correct an unjust situation and one that all homeowners, both within Anthem Country Club and outside of it, should be concerned with. As such, the donation policy is aligned for fairness of contributors.

Received contributions will be applied in the following order:

  • Payment of current and ongoing legal fees
  • Payment of operating expenses such as the operation of the website, materials for contributor solicitations (e.g. mail, printing notices, etc.)
  • Payment of any judgements awarded to the Defendant, if so ordered.
 

In the event of a victory where damages are awarded (legal fees, punitive damages, etc.) directly to the Plaintiff, contributors will be reimbursed proportionally based on their donation to the total costs incurred, less a consideration of 10% of any award to the Plaintiff for pursuing the matter. Reimbursements will be made when the matter has completely concluded, meaning any appeals are exhausted and Counsel has indicated that the matter is closed. Damages used in the calculation are only based on those awarded directly to Plaintiff, and calculations will not include any additional damages or remedies The Court may provide to other homeowners (past or present) of Anthem Country Club.

While contributors may make “anonymous” contributions on GoFundMe, organizers are able to see the contact information for the contributor. Please provide your valid contact information when making any contributions so that reimbursements can be processed in a timely manner. If we are unable to reach you via the provided contact information after 30 days reimbursements are deemed due, the reimbursement will be forfeit. Any excess funds from failed reimbursements will be donated to a local charitable organization.

Consideration for Individual Settlement

While the purpose of litigation is to obtain an outcome that benefits the community as a whole, in the event Counsel deems the only path forward involves an individual settlement, all contributions will be refunded within 180 days. Additionally, if an individual settlement is reached prior to The Club being served and in spite of The Club’s untimely response, any received contributions will be refunded within 30 days of acceptance of the settlement.

Consideration for Abandonment and New Plaintiff

In the event Counsel deems the best path forward involves abandoning current litigation and selecting a new Plaintiff, all funds will be utilized in a manner to support the new Plaintiff’s litigation and all other policies will apply. In this event, the 10% consideration will be split between the original Plaintiff and subsequent Plaintiff(s) related to this matter.
